1. Agreement to these terms

These Terms of Service ("Terms") govern your use of castare.com (the "Site") and any purchase you make from Castare, operated by [LEGAL ENTITY NAME] ("Castare," "we," "us" or "our"). By visiting the Site or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy and Return Policy, which are part of these Terms.

If you do not agree, please do not use the Site.

You must be at least 18 years old, or the age of majority where you live, to place an order. If you order for someone else, including a minor, you confirm you are authorized to do so and accept these Terms on their behalf.

2. Products, orders and payment

  • Product details. We work to show our frames, lenses and colors accurately. Colors and finishes can look slightly different depending on your screen, and handmade acetate can vary slightly from pair to pair.
  • Orders. Your order is an offer to buy. We accept it when we send a shipping confirmation. We may refuse or cancel any order, including for suspected fraud, pricing errors or stock issues, and will refund any amount charged.
  • Pricing. Prices are listed in US dollars and may change without notice. Taxes and shipping are calculated at checkout. If a product is listed at the wrong price, we may cancel the order and refund you.
  • Add-ons. Prescription lenses, lens tiers (Standard, Medium, Complex) and lens upgrades are priced separately and are added to the frame you select.
  • Payment. Payment is due at checkout through the methods shown on the Site. You confirm you are authorized to use the payment method you provide.
  • Promotions. Discount codes have their own conditions, cannot be combined unless stated, and have no cash value.

3. Prescription eyewear

  • Valid prescription. Prescription lenses require a current, valid prescription from a licensed eye care professional, issued within [24] months. You confirm the prescription you submit is yours (or belongs to the person you are ordering for) and has not expired.
  • Accuracy is your responsibility. We make lenses from the details you enter or upload, including sphere, cylinder, axis, add and pupillary distance (PD). We are not responsible for lenses made incorrectly because of inaccurate or incomplete details. If anything is unclear, we may contact you or pause the order.
  • Lens tiers. Your lens tier (Standard, Medium or Complex) is based on your prescription strength. If the tier you choose does not match your prescription, we may contact you to adjust the order and price.
  • Adjustment period. New prescription glasses can take a few days to adjust to, especially with a new prescription or a new frame size.
  • Not medical advice. Castare does not provide eye exams or medical advice. Our glasses do not diagnose, treat or prevent any condition. See an eye care professional regularly and for any vision concerns.
  • Blue light and light-adaptive lenses. Blue light filtering lenses are designed to help filter a portion of blue light and reduce glare. Light-adaptive lenses darken in UV light and may react less inside cars or in cold or hot weather. Neither is a medical device.

4. Shipping, returns and warranty

  • Shipping. Delivery times on the Site are estimates. Prescription orders take extra time to make before they ship. Risk of loss passes to you when the order is handed to the carrier. Full details are in our Shipping Policy.
  • Returns on non-prescription glasses. Unworn items in original condition and packaging may be returned within [30] days of delivery, as set out in our Return Policy.
  • Prescription lenses are custom. Because they are made to your prescription, prescription lenses and lens upgrades are non-refundable, except where they arrive damaged, defective or made differently from the prescription you submitted.
  • Remakes. If your lenses do not match your submitted prescription, contact us within [30] days of delivery and we will remake them at no cost.
  • Warranty. Frames are covered against manufacturing defects for [12] months from delivery. The warranty does not cover normal wear, scratches, accidental damage, misuse or unauthorized repairs.
  • Refunds. Approved refunds go back to the original payment method. Shipping costs are non-refundable unless the return is due to our error.

5. Accounts, use of the Site and content

  • Accounts. Keep your login details secure. You are responsible for activity under your account and for keeping your information accurate.
  • Acceptable use. You agree not to misuse the Site, including by breaking any law, interfering with its security or operation, scraping or copying it, using bots, reselling products commercially without our written permission, or submitting false orders or prescriptions.
  • Intellectual property. The Castare name, logo, designs, photos, text and all other Site content belong to Castare or its licensors and are protected by trademark and copyright law. You may not copy, reproduce or use them without our written permission.
  • Reviews and submissions. If you post a review, photo or other content, you confirm it is your own honest experience and that you have the right to share it. You give us a non-exclusive, royalty-free, worldwide license to use, display and share it in connection with Castare, including in marketing. We may remove content that is false, offensive or breaks these Terms.

6. Disclaimers and limits of liability

  • As is. Except for the warranty in Section 4 and any rights you have under law, the Site and products are provided "as is" and "as available," without other warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
  • Limitation of liability. To the fullest extent permitted by law, Castare will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product involved.
  • Indemnity. You agree to cover Castare against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or inaccurate prescription details you submit.
  • Your rights. Some places do not allow certain warranty exclusions or liability limits, so parts of this section may not apply to you.

7. Governing law, changes and contact

  • Governing law. These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in [COUNTY, STATE], unless the law where you live requires otherwise.
  • Resolve it with us first. Before starting any legal claim, please contact us so we can try to resolve the issue informally within 30 days.
  • Changes. We may update these Terms at any time. The updated version takes effect when posted on the Site, and the date at the top will change. Orders placed before an update follow the Terms in place when you ordered.
  • Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
